ABSTRACTThis article looks to Attic comedy to explain Socrates’ first argument in Plato's Hippias Major: his refutation of Hippias’ claim that the Beautiful is a beautiful girl. As part of his argument, Socrates introduces three examples of beautiful things—a mare, a lyre and a pot —all of which are used in comedy as metaphorical obscenities for sexualized women. The author contends that an erotic reading of the text accomplishes what no other interpretation can: a unified account of the passage that (...) allows for Socrates’ successful refutation of a proposal in keeping with Hippias’ character. In addition, it explains Socrates’ choice of examples—in particular, the rarely cited χύτρα—and Hippias’ otherwise inexplicable reaction to the χύτρα, as well as the analogous relationship of monkeys and men to pots and girls. Before the advent of fibrinolytic therapy as a gold standard method of care for cases of acute ischemic stroke in Romania, issues regarding legal medicine aspects involved in this area of medical expertise were already presented and, in the majority of cases, the doctors seem to be unprepared for these situations. The present research illustrates some of the cases in which these aspects were involved, that adressed a clinical center having 6 years of professional experience in the application of (...) fibrinolytic treatment for stroke. The following cases report either situations in which the afore mentioned therapy was not rightfully administrated or legal aspects regarding the obtainment of informed consent. Obtaining informed consent is a mandatory procedure, which takes time, to the detriment of application of fibrinolytic treatment. (shrink)

In the literature of collective intentions, the ‘we-intentions’ that lie behind cooperative actions are analysed in terms of individual mental states. The core forms of these analyses imply that all Nash equilibrium behaviour is the result of collective intentions, even though not all Nash equilibria are cooperative actions. Unsatisfactorily, the latter cases have to be excluded either by stipulation or by the addition of further, problematic conditions. We contend that the cooperative aspect of collective intentions is not a property of (...) the intentions themselves, but of the mode of reasoning by which they are formed. We analyse collective intentions as the outcome of team reasoning, a mode of practical reasoning used by individuals as members of groups. We describe this mode of reasoning in terms of formal schemata, discuss a range of possible accounts of group agency, and show how existing theories of collective intentions fit into this framework. A framing effect occurs when an agent's choices are not invariant under changes in the way a decision problem is presented, e.g. changes in the way options are described (violation of description invariance) or preferences are elicited (violation of procedure invariance). Here we identify those rationality violations that underlie framing effects. We attribute to the agent a sequential decision process in which a “target” proposition and several “background” propositions are considered. We suggest that the agent exhibits a framing effect if (...) and only if two conditions are met. First, different presentations of the decision problem lead the agent to consider the propositions in a different order (the empirical condition). Second, different such “decision paths” lead to different decisions on the target proposition (the logical condition). The second condition holds when the agent's initial dispositions on the propositions are “implicitly inconsistent,” which may be caused by violations of “deductive closure.” Our account is consistent with some observations made by psychologists and provides a unified framework for explaining violations of description and procedure invariance. To date, COVID-19 has spread across the world, changing our way of life and forcing us to wear face masks. This report demonstrates that face masks influence the human ability to infer emotions by observing facial configurations. Specifically, a mask obstructing a face limits the ability of people of all ages to infer emotions expressed by facial features, but the difficulties associated with the mask’s use are significantly pronounced in children aged between 3 and 5 years old. These findings are (...) of essential importance, as they suggest that we live in a time that may potentially affect the development of social and emotion reasoning, and young children’s future social abilities should be monitored to assess the true impact of the use of masks. Sometimes we make a decision about an action we will undertake later and form an intention, but our judgment of what it is best to do undergoes a temporary shift when the time for action comes round. What makes it rational not to give in to temptation? Many contemporary solutions privilege diachronic rationality; in some “rational non-reconsideration” (RNR) accounts once the agent forms an intention, it is rational not to reconsider. This leads to other puzzles: how can someone be motivated (...) to follow a plan that is contrary to their current judgment? How can it be rational to form a plan to resist if we can predict that our judgment will shift? I show how these puzzles can be solved in a framework where there are multiple units of agency, distinguishing between the judgments of the timeslice and those of the person over time, and allowing that the timeslice can “self identify”, taking the person over time as the relevant unit of agency and doing intrapersonal team reasoning (with a different causal role for intentions than RNR accounts). On my account, resisting temptation is compatible with synchronic rationality, so synchronic and diachronic rationality are aligned. However, either resisting or succumbing to temptation can be instrumentally rational, depending on the unit of agency that is identified with. In order to show why we ought to resist temptation, we need to draw on a non-instrumental rationale. I sketch possible routes for doing this. (shrink)

Since 1992, institutions accredited by The Joint Commission have been required to have a process in place that allows staff members, patients, and families to address ethical issues or issues prone to conflict. While the commission's expectations clearly have made ethics committees more common, simply having a committee in no way demonstrates its effectiveness in terms of the availability of the service to key constituents, the quality of the processes used, or the outcomes achieved. Beyond meeting baseline accreditation standards, effective (...) ethics resources are requisite for quality care for another reason. The provision of care to the sick is a practice with profound moral dimensions. Clinicians need what Margaret Urban Walker has called “moral spaces,” reflective spaces within institutions in which to explore and communicate values and ethical obligations as they undergird goals of care. Walker proposed that ethicists needed to be concerned with the design and maintenance of these moral spaces. Clearly, that concern needs to extend beyond ethicists to institutional leaders. This essay uses Walker's idea of moral space to describe individuals and groups who are actual and potential ethics resources in health care institutions. We focus on four requisite characteristics of effective resources and the challenges to achieving them, and we identify strategies to build them. In our view, such moral spaces are particularly important for nurses and their colleagues on interprofessional teams and need to be expanded and strengthened in most settings. (shrink)

Through a series of semistructured interviews with 12 nurses delivering direct patient care in acute, long-term and home care settings, information was sought regarding the ethical concerns of practicing nurses. Although these nurses frequently did not specifically identify the areas of expressed concern as ethical in nature, thematic analysis of the transcribed interviews uncovered four major ethical areas of concern common to these 12 nurses. These areas are: (1) Withholding of information and truth-telling; (2) Unequal access or inequalities in care; (...) (3) Differences between business and professional values; (4) Breaking and reporting broken rules. Several reasons are offered to explain the failure of nurses accurately to identify specific practice dilemmas as ethical in nature and the sequelae of these failures. Possibilities involving ongoing education and mentored experiences in practice areas are reported. (shrink)

Este artículo reflexiona sobre la segregación socio-espacial en contextos urbanos, comprendiéndola como una dimensión particular de los procesos de estructuración social en las ciudades capitalistas. Concretamente, se aborda el caso de la ciudad de Córdoba (Argentina). Se parte del supuesto de que el crecimiento urbano por expansión que se registra durante la década del `80, es el resultado de un doble proceso de larga duración. Por un lado, políticas de desarrollo urbano que buscan incrementar la productividad y atraer inversiones privadas (...) que re-cualifiquen espacios estratégicos de la ciudad. Por otro lado, y subsidiario del proceso anterior, la progresiva ocupación diferencial del área periférica de acuerdo a posiciones y condiciones de clase. Se concluye que la suburbanización que se registra en la ciudad forma parte de una política general de (re)valorización urbana orientada hacia el capital privado, y que ya desde los primeros años de la transición democrática pueden observarse en Córdoba incipientes marcas de una periferia segmentada en términos de clase. La estrategia metodológica articula el análisis de datos provenientes de fuentes secundarias (indicadores urbanos, socio-demográficos y habitacionales) con el abordaje cualitativo de intervenciones urbanas y marcos normativos sancionados a mediados de la década del ’80. Normative theories can be useful in developing descriptive theories, as when normative subjective expected utility theory is used to develop descriptive rational choice theory and behavioral game theory. “Ought” questions are also the essence of theories of moral reasoning, a domain of higher mental processing that could not survive without normative considerations.

In the "cratylus", Plato presents two theories about the correctness of names, I.E., Names are correct by nature and names are correct by convention. In this paper, I argue that plato holds both views because he recognizes that the word 'name' is ambiguous as between type and token. Name tokens (individual strings of marks and noises) are conventional for plato. But name types (the role played by the tokens or the concept expressed by the tokens) are not conventional for plato.

Extreme intentional and deliberate violence against innocent people, including acts of terror and school shootings, poses various ethical challenges, some related to the practice of medicine. We discuss a dilemma relating to deliberate violence, in this case the aftermath of a terror attack, in which there are multiple injured individuals, including the terror perpetrator. Normally, the priority of medical treatment is determined based on need. However, in the case of a terror attack, there is reason to question this. Should the (...) perpetrator of extreme violence receive medical treatment on the scene before the victims if he or she is designated as the most seriously injured? Or rather, should victims receive medical care priority if they are also in some life-threatening danger, although not at the same level of severity as the perpetrator? We present two opposing approaches: the conventional ‘no-exceptions’ approach, which gives priority to the terrorist, and the justice-oriented ‘victim first’ approach, which gives priority to the victims. Invoking concepts of retributive justice, distributive justice and corrective justice, this latter approach suggests that ‘value-neutrality’ can lead to injustice. Perpetrators of terror-like violence should be treated as an act of humanism and good ethical medical practice. However, in clear and obvious terror-like situations, to treat the perpetrators of violence before their victims may be unjust. Thus, in some specific situations, the ‘victim first’ approach may be considered a legitimate alternative triage policy. (shrink)

This essay defends a Buddhist answer to the question of how a skeptical tradition might account for its moral position. Two domains in Buddhist thought and practice are often considered to be dissimilar, perhaps contradictory. On the one hand, there is an aspiration to nirvana and a philosophy that describes everything as “emptiness” and rejects, with apparent universality, “attachment to views.” On the other hand, Buddhist traditions of practice recommend actions based in compassion and loving kindness, and the cultivation of (...) contentment, introspective awareness, and peace of mind. It is argued that these arenas are not in conflict, but are linked through Buddhist psychology, wherein the proven limitations of concepts are quite explicitly leveraged to show that beings hampered by such limits ought to think and act with epistemic humility. The result is not nihilism, but a method for improving our perspectives on ourselves and our society—a method that may serve as a model for humanistic research. (shrink)

_Contributions to Law, Philosophy and Ecology: Exploring Re-Embodiments_ is a preliminary contribution to the establishment of re-embodiments as a theoretical strand within legal and ecological theory and philosophy. Re-embodiments are all those contemporary practices and processes that exceed the epistemic horizon of modernity. As such, they offer a plurality of alternative modes of theory and practice that seek to counteract the ecocidal tendencies of the Anthropocene. The collection is comprised of eleven contributions approaching re-embodiments from a multiplicity of fields, including (...) legal theory, eco-philosophy, eco-feminism and anthropology. The contributions are organized in three parts, ‘Beyond Modernity, ‘The Sacred Dimension’ and ‘The Legal Dimension’. The collection is opened by a comprehensive introduction that situates re-embodiments in theoretical context. Whilst closely bound with embodiment and new materialist theory, this book_ _contributes a unique voice that echoes diverse political processes contemporaneous to our times. Written in an elegant and accessible language, the book will appeal to undergraduates, postgraduates and established scholars alike seeking to understand and take re-embodiments further, both politically and theoretically. The metaphor of “repertoire” is increasingly used in the study of contention to convey the fact that people act collectively through a limited set of cultural routines. Yet despite its broad adoption, the term is loosely defined and rarely subject to empirical verification. This has led to unfruitful scholarly disputes, with most perspectives assuming that change in repertoires is independent from how actors perform them. Drawing a parallel between the dynamics of repertoire performance and jazz improvisation, I propose a pragmatist (...) definition of repertoires, understood as relational sets of collective practices that become routinized as habit-sets and become a baseline for innovation when actors face puzzling situations. I then provide a theoretical model for analyzing change in contentious repertoires, which relies on the study of the co-constitutive relation between tactical affordances, actors’ strategies and identities, and contexts. I illustrate this model with three secondary cases of unexpected tactical innovation. (shrink)

Physician-assisted death (PAD) of patients whose suffering does not stem from terminal conditions has become more prevalent during the last few decades. This paper is focused on decision-making competence for PAD, specifically in situations in which PAD is related solely to psychiatric illness. First, a theoretical analysis presents the premises for the argument that competence for physician-assisted death for psychiatric patients (PADPP) should be determined based on a higher threshold in comparison to the required competence for conventional medical interventions. Second, (...) the higher threshold for decision-making competence for PADPP is illustrated. Third, several real PADPP cases are critically discussed, as an illustration to decision-making competence evaluations that would not have met the higher standard. Finally, a short summary of practical suggestions regarding the assessment of decision-making competence for PADPP is presented. Psychiatrists are called to address the ethical, legal, societal and clinical challenges related to PADPP and should be prepared for its probable expansion. (shrink)

Increasing reports of financial entanglements involving scientist and industry have led some to question the neutrality of research results. In December 2003, a story in the Los Angeles Times shocked readers by exposing several cases of NIH scientists embroiled in serious financial conflicts of interest.1 It was revealed, for example, that senior NIH official Stephen Katz was a paid consultant to Schering AG, a German pharmaceutical company with which he was involved in conducting clinical trials. In a similar case, John (...) Gallin, director of the NIH's Clinical Center, was discovered to have co-authored an article on a company's gene-transfer technology, while being paid as a consultant to a subsidiary of the same company. Jeffrey Schlom, director of the National Cancer Institute's Laboratory of Tumor Immunology and Biology, helped direct NIH-funded studies examining wider use for a particular cancer drug while serving as a consultant whose highest-paying client was looking to genetically engineer that drug. This essay reviews John Gardner’s recent books, From Personal Life to Private Law, and Torts and Other Wrongs. Both books offer profound insights into private law’s concerns with justice and our reasons for action. The essay focuses on Gardner’s continuity thesis, and in particular on his idea that a third party may act on behalf of a wrongdoer as her delegee. Three settings are considered. First, I will discuss settings in which the state or another third party acts to remedy (...) a wrong without the wrongdoer’s consent. Second, I will review settings in which the legal remedies at issue – e.g., general damages or punitive damages – may not fit well with the idea that the state is acting on behalf of a wrongdoer. Third, I will analyze settings in which the state may be acting on behalf of right holders, yet still be concerned with the continuity thesis. Assessing each of these contexts offers further insights into the purpose of private law remedies. (shrink)

This paper addresses one aspect of the natural law theory of Germain Grisez. According to Grisez, practical reason identifies the goods of human life prior to the invocation of any moral or normative notions. It can thus provide a non-normative foundation for moral theory. I present Grisez’s position and argue that the apparently non-normative aspect of natural law cannot support the moral position built upon it. I argue, in particular, that practical principles, as Grisez understands them, are best understood as (...) speech acts. If this is correct, it is possible to develop a sceptical challenge to Grisez’s position. (shrink)

ABSTRACT Between the publication of Montaigne's Essais and Hobbes's Leviathan rhetors became increasingly anxious about arguing in utramque partem. Paradiastolic discourse, fundamental to Montaigne's early essays, is anxiously though expertly deployed in Leviathan. Paradiastole fuses the ability to see and speak about an issue from antithetical perspectives with the ambivalence such power arouses in. Beyond their skepticism, Montaigne and Hobbes share a concern for how phenomena can be interpreted and represented through language. Despite Hobbes's desire for a method that would (...) ensure constant and determinate linguistic acts that would render rhetoric supererogatory, Leviathan demonstrates his unremarkable affinities with mainline Renaissance humanists alongside his uneasy affinities with the Sophists. Both the humanist and the Sophist used the trope to probe and to persuade, though both were anxious about the reversibility of such rhetorical redescriptions. Paradiastolic discourses, we argue, integrate the cognitive procedures of philosophy with the judicative procedures of rhetoric. The trope operates through exploiting the reciprocity between similar qualities, as exemplified by the influential paradiastolic pairing of ferox and fortis. (shrink)
